APPLICATION by Champlain Enterprises, Inc. doing business as CommutAir doing business as USAir Express doing business as US Airways Express to reinstate Licence Nos. 980187 and 980188.

Champlain Enterprises, Inc. doing business as CommutAir doing business as USAir Express doing business as US Airways Express (hereinafter the Licensee) has applied to the Canadian Transportation Agency (hereinafter the Agency) for the reinstatement of Licence Nos. 980187 and 980188. The application was received on May 9, 2002 and was complete and ready for processing on May 16, 2002.

Under Licence No. 980187, the Licensee is authorized to operate a non-scheduled international service to transport traffic on a charter basis between points in the United States of America and points in Canada.

Under Licence No. 980188, the Licensee is authorized to operate a scheduled international service between points in the United States of America and points in Canada.

By Decision No. 224-A-2002 dated May 1, 2002, Licence Nos. 980187 and 980188 were suspended pursuant to paragraphs 72(2)(b) and 75(2)(b) of the Canada Transportation Act, S.C., 1996, c. 10 (hereinafter the CTA). Pursuant to that Decision, the Licensee was provided with a period of one year from the date of the Decision to file an application to reinstate the said licences.

The Agency notes that the Licensee has changed its name to Champlain Enterprises, Inc. carrying on business as CommutAir and Continental Connection.

The Agency has reviewed the application and is satisfied that the Licensee meets the requirements of paragraph 69(1)(a) and subparagraphs 73(1)(a)(ii) and (iii) and paragraph 73(2)(a) of the CTA.

Accordingly, the suspension of Licence Nos. 980187 and 980188 imposed by Decision No. 224-A-2002 dated May 1, 2002 is no longer in effect.

In addition, new documents of licence, bearing Licence Nos. 980187 and 980188 will be issued to Champlain Enterprises, Inc. carrying on business as CommutAir and Continental Connection.
