Decision No. 413-R-1997

APPLICATION by the Quebec North Shore & Labrador Railway Company, pursuant to section 91 of the Canada Transportation Act, S.C., 1996, c. 10, for a certificate of fitness to permit it to operate a railway between: Sept-Îles and Schefferville, Quebec;

Ross Bay Junction and Wabush, Newfoundland; and

Wabush Lakes Junction and Labrador City, Newfoundland.

The segment of railway between Ross Bay Junction and Wabush Lakes Junction will be operated by virtue of a running rights agreement with Northern Lands Company Limited.

The Quebec North Shore & Labrador Railway Company has applied to the Canadian Transportation Agency (hereinafter the Agency) for the certificate set out in the title. The application was received on April 15, 1997.

The Agency has reviewed the material filed and is satisfied that there will be adequate third party liability insurance coverage, including self-insurance, for the proposed railway operation by the Quebec North Shore & Labrador Railway Company.

Accordingly, pursuant to subsections 92(1) and (2) of the Canada Transportation Act, the Agency will issue a certificate of fitness to the Quebec North Shore & Labrador Railway Company authorizing it to operate a railway between:

Sept-Îles and Schefferville, Quebec;

Ross Bay Junction and Wabush, Newfoundland; and

Wabush Lakes Junction and Labrador City, Newfoundland.

The segment of railway between Ross Bay Junction and Wabush Lakes Junction will be operated by virtue of a running rights agreement with Northern Lands Company Limited.
