Order No. 1991-A-557

IN THE MATTER OF the operation of a Class 4 Charter domestic service and a domestic service by Art's Flying Service Ltd. - Licence Nos. 883530 and 883531.

WHEREAS under Licence No. 883530, Art's Flying Service Ltd. (hereinafter the Licensee) is authorized to operate a Class 4 Charter domestic service using fixed wing aircraft in Group A, from a base at Whiteshell Lake, Manitoba;

AND WHEREAS under Licence No. 883531, the Licensee is authorized to operate a domestic service;

AND WHEREAS Transport Canada advised the Agency that the operating certificate of the Licensee was suspended effective October 4, 1991;

AND WHEREAS the Agency notes that the certificate of insurance of the Licensee expired on October 10, 1991;

AND WHEREAS the Agency has reasonable grounds to believe that, in respect of the services for which the licences are issued, the Licensee ceases to have the qualifications necessary for the issuance of the licences and has contravened section 98 of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.);

AND WHEREAS the Agency has reviewed the matter and considers it appropriate to suspend Licence Nos. 883530 and 883531 and to require the Licensee to show cause why the said licences should not be cancelled.

NOW THEREFORE, IT IS ORDERED THAT:

  1. Licences Nos. 883530 and 883531 are hereby suspended pursuant to subsection 75(1) of the National Transportation Act, 1987.
  2. The Licensee is hereby required to show cause within thirty (30) days from the date of this Order why the said licences should not be cancelled pursuant to subsection 75(1) of the National Transportation Act, 1987.

This Order shall form part of Licence Nos. 883530 and 883531 and shall remain affixed thereto as long as the said Order is in force.
