Order No. 1997-A-200

April 11, 1997

IN THE MATTER OF the suspension of NTA Licence No. 950315 imposed by Order No. 1997-A-135 dated March 12, 1997 - Associated Aviation Underwriters, Inc. File No. M4895/A694-9-1

WHEREAS Associated Aviation Underwriters, Inc. (hereinafter the Licensee) holds NTA Licence No. 950315 which specifies that the Licensee is authorized to operate a Class 9-4 Charter non-scheduled international service to transport traffic between points in Canada and points in the United States of America;

AND WHEREAS by Order No. 1997-A-135 dated March 12, 1997, NTA Licence No. 950315 was suspended pursuant to paragraph 75(1)(b) of the Canada Transportation Act, S.C., 1996, c. 10 (hereinafter the CTA), for failure by the Licensee to file with the Canadian Transportation Agency (hereinafter the Agency) a valid certificate of insurance. The Licensee was required to show cause within thirty days from the date of the Order why NTA Licence No. 950315 should not be cancelled pursuant to paragraph 75(1)(b) of the CTA;

AND WHEREAS the Air Transportation Regulations, SOR/88-58 have been amended to simplify the various classes of air services that may be operated by a non-Canadian air carrier under a non-scheduled international licence. Accordingly, the Class 9-4 Charter non-scheduled international service operated under NTA Licence No. 950315 is now considered to be a non-scheduled international service;

AND WHEREAS the Licensee has filed a valid certificate of insurance. The Agency is satisfied that the Licensee now meets the requirements of subparagraphs 73(1)(a)(ii) and (iii) and paragraph 73(2)(a) of the CTA and finds that the suspension imposed by Order No. 1997-A-135 should be lifted. In addition, the Agency considers it appropriate to issue a replacement licence to Associated Aviation Underwriters, Inc.

NOW THEREFORE, IT IS ORDERED THAT:

The suspension of NTA Licence No. 950315 imposed by Order No. 1997-A-135 dated March 12, 1997 is hereby lifted.

The Agency will issue replacement Licence No. 977209 to Associated Aviation Underwriters, Inc. authorizing it to operate a non-scheduled international service.
