IN THE MATTER OF Decision No. 33-A-1997 dated January 31, 1997 - Aviation Portneuf Ltée.

Under Licence No. 962295, Aviation Portneuf Ltée (hereinafter the Licensee) is authorized to operate a domestic service, small aircraft.

By Decision No. 33-A-1997 dated January 31, 1997, Licence No. 962295 was suspended, during the period between freeze-up and break-up of each year, pursuant to paragraph 63(2)(b) of the Canada Transportation Act, S.C., 1996, c. 10 (hereinafter the CTA). Decision No. 33-A-1997 also provided that the suspension of Licence No. 962295 would be lifted annually provided that the Licensee meets the requirements of paragraph 61(a) of the CTA.

The Licensee has advised Agency staff that it now intends to operate its service on a year-round basis. The Agency notes that the Licensee meets the requirements of section 61 of the CTA.

The Agency has considered the matter and has found, pursuant to section 32 of the CTA, that there has been a change in the facts or circumstances pertaining to Decision No. 33-A-1997 since it issued and that the Decision should be rescinded.

Accordingly, Decision No. 33-A-1997 is hereby rescinded.
