

The Canada Transportation Act empowers the Agency to resolve complaints over noise and vibration related to construction or operations carried out by federally-regulated railways and public passenger rail service providers. The Agency may order a railway company to undertake any measures that the Agency deems reasonable to ensure that the railway company is in compliance with the noise and vibration provisions of the Act. The Agency must, however, take into account the railway's operational requirements, its legal obligations regarding the level of service provided to its clients, and the area where the railway construction or operations take place.
