Determination by the Canadian Transportation Agency (Agency) of the 2024 annual adjustment of the maximum amount of compensation that the Agency can direct to be paid pursuant to Part V of the Canada Transportation Act, SC 1996, c 10 (CTA)

[1] On determining that there is an undue barrier to the mobility of persons with disabilities or that a person has been adversely affected by the contravention of any provision of accessibility regulations made by the Agency, the Agency may award compensation of up to $20,000 for pain and suffering and compensation of up to that same amount if it determines that the undue barrier or contravention is the result of a willful or reckless practice. Pursuant to section 172.2 of the CTA, this maximum amount of compensation must be adjusted annually, and the Agency must publish the adjusted amount.

[2] The Agency has calculated the adjusted maximum for the year 2024 in accordance with the formula set out in subsections 172.2(1) and (2) as follows:

Base amount in 2023 x Consumer Price Index for Canada (CPI)2023/(CPI)2022

=Base amount of $22,244.44 x 157.11 (2023 CPI) / 151.24 (2022 CPI)

=$23,107.80

[3] In Determination AT-2023-137, the Agency determined that the adjusted amount for 2023 is $22,244.44. This amount was therefore used as the base amount in the calculation above.

[4] The Agency accordingly determines that $23,107.80 is the adjusted amount for the year 2024.
