March 12, 2003

APPLICATION by Air Canada for authority pursuant to subsection 78(2) of the Canada Transportation Act, S.C., 1996, c. 10, to operate the route Toronto-Dublin-Shannon-Toronto while providing its scheduled international service between Canada and Ireland for the period May 3 to October 25, 2003.

File No. M4210/A74-4-5Docket No. 030173AG

Air Canada has applied to the Canadian Transportation Agency (hereinafter the Agency) for the authority set out in the title. The application was received on February 12, 2003.

Under Licence No. 975030, Air Canada is authorized to operate a scheduled international service, large aircraft, in accordance with the Agreement between Canada and Ireland for Air Services signed on August 8, 1947 (hereinafter the Agreement).

Condition No. 1 of Licence No. 975030 states:

The Licensee is authorized to operate the route(s) set out in the Agreement, operation to (a) specified point(s) in a third country on the route(s) set out in the said Agreement being subject to the Licensee holding another scheduled international licence issued by the Agency that permits the Licensee to operate a scheduled international service to and/or from the respective third country(ies) concerned.

Under the terms of the Agreement, the specified route to be operated by the designated airline or airlines of the Government of Canada shall be Montreal via intermediate points to Shannon and points in countries beyond in both directions. Further, the Agreement requires that all eastbound aircraft on the routes covered in the Annex shall stop at Shannon Airport and all westbound aircraft on the same routes shall stop at Shannon Airport.

In support of its application, Air Canada has provided the Agency with a copy of the approval granted by the Aeronautical Authorities of Ireland in respect of the proposed services.

The Agency has reviewed and considered the application and the material filed in support thereof and is satisfied that the amendment of Licence 975030 to permit the operation of Air Canada's scheduled international service on the route Toronto-Dublin-Shannon-Toronto would be beneficial to the travelling public.

Accordingly, the Agency, pursuant to subsection 78(2) of the Canada Transportation Act, hereby varies Condition No. 1 of Licence No. 975030 in order to authorize Air Canada to operate the route Toronto-Dublin- Shannon-Toronto while providing its scheduled international service between Canada and Ireland, for the period May 3 to October 25, 2003.

The authority granted herein does not exempt Air Canada from the requirements of other legislative acts or regulations, including those of Transport Canada.

This Decision shall form part of Licence No. 975030 and shall remain affixed thereto as long as this Decision is in force.
