APPLICATION by Sowind Air Ltd. for authority to also use fixed wing aircraft in Groups A and C and to also serve the point Deer Lake, Ontario under Licence No. 920108.

Sowind Air Ltd. (hereinafter the applicant) has applied to the National Transportation Agency for authority to operate the service set out in the title. The application was received on October 2, 1992 and was complete and ready for processing on October 28, 1992.

Under Licence No. 920108, the applicant is authorized to operate a Class 3 Specific Point domestic service using fixed wing aircraft in Group B, serving the points Winnipeg, Bloodvein, Little Grand Rapids, Berens River and Poplar River, Manitoba.

Notice of the application was posted at the post office of Little Grand Rapids and in a public place in Deer Lake. Copies of the notice were also sent to selected air carriers and to others believed to be interested. No interventions opposing the granting of the application were filed with the Agency.

The applicant has now filed Section II of its application in respect of the authority to use fixed wing aircraft in Group A and the authority to serve the point Deer Lake, Ontario. The Agency has reviewed the material filed and is satisfied that the applicant meets the requirements set out in paragraph 72(2)(a) of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.), in respect of the authority to use fixed wing aircraft in Group A and the authority to serve the point Deer Lake, Ontario.

To make provision for the level of Class 3 service to be consistent with demand anticipated by the applicant and in accordance with the applicant's indicated intentions, the Agency finds it in the public interest to authorize the Licensee to also use fixed wing aircraft in Group A.

Condition No. 1 of Licence No. 920108 is hereby amended to read:

The Licensee is authorized to use fixed wing aircraft in Groups A and B.

The Agency notes that the operating certificate issued by Transport Canada to Sowind Air Ltd. reflects the point Bloodvein River, Manitoba while Licence No. 920108 indicates the point Bloodvein, Manitoba. In this respect, the Agency has reviewed the matter and considers it appropriate in the public interest to amend Licence No. 920108 by changing the point Bloodvein to read Bloodvein River.

Pursuant to subsection 72(4) of the National Transportation Act, 1987, Licence No. 920108 is hereby amended by changing the point Bloodvein, Manitoba to read Bloodvein River, Manitoba.

Accordingly, a new document of licence, bearing Licence No. 920108, authorizing Sowind Air Ltd. to serve the points Winnipeg, Bloodvein River, Little Grand Rapids, Berens River and Poplar River, Manitoba; and Deer Lake, Ontario, using fixed wing aircraft in Groups A and B only, will be issued.

With respect to the authority to use fixed wing aircraft in Group C, the applicant should file Section II of its application with the Agency within one year from the date of this Decision. If the applicant does satisfy the Agency within this period that it has the necessary qualifications for licence issuance, the Agency shall issue a new document of licence. If the applicant does not establish to the satisfaction of the Agency, within one year from the date of this Decision, that it has the said qualifications with respect to the authority to use fixed wing aircraft in Group C, this shall result in the closing of the Agency file regarding that portion of the application.
