IN THE MATTER OF the operation of Class 4 Charter domestic services, a domestic service and a Class3 Specific Point domestic service by Air-Sask Aviation Ltd.- Licence Nos.880134, 880135, 880136 and 890212.

WHEREAS under Licence No. 880134, Air-Sask Aviation Ltd. (hereinafter the Licensee) is authorized to operate a Class4 Charter domestic service using fixed wing aircraft in GroupsA, B and C, from a base at La Ronge, Saskatchewan;

AND WHEREAS under Licence No. 880135, the Licensee is authorized to operate a Class4 Charter domestic service using fixed wing aircraft in GroupsA and B, from a base at Pinehouse, Saskatchewan;

AND WHEREAS under Licence No. 880136, the Licensee is authorized to operate a domestic service;

AND WHEREAS under Licence No. 890212, the Licensee is authorized to operate a Class3 Specific Point domestic service using fixed wing aircraft in Group B, serving the points La Ronge, Wollaston Lake and Prince Albert, Saskatchewan;

AND WHEREAS by Order No.1993-A-53 dated February 18, 1993, Licence No.880135 was suspended pursuant to subsection75(2) of the National Transportation Act, 1987, R.S.C.,1985, c.28 (3rdSupp.) (hereinafter the NTA,1987). The Licensee was required to file an application by no later than February 14, 1994 to reinstate the suspended service which would establish to the satisfaction of the Agency that it is Canadian, holds a Canadian aviation document (operating certificate) and has filed a valid certificate of insurance. Alternatively, if the said application was not filed, the Licensee was required to show cause by no later than February 14, 1994, why its licence should not be cancelled pursuant to subsection 75(1) of the NTA,1987, as failure to meet the requirements would give reasonable grounds to the Agency to believe that, in respect of the service for which the licence is issued, the Licensee ceases to have the qualifications necessary for the issuance of the licence and/or has contravened section98 of the NTA,1987;

AND WHEREAS by registered letter dated October 18, 1993, Licence Nos.880134, 880136 and 890212 were suspended pursuant to subsection75(1) of the NTA, 1987, for failure by the Licensee to hold a valid operating certificate. The Licensee was required to show cause within twenty-one (21)days from the date of the letter why Licence Nos.880134, 880136 and 890212 should not be cancelled pursuant to subsection75(1) of the NTA, 1987;

AND WHEREAS by letter dated November 25, 1993, the Licensee requested the cancellation of its licences;

AND WHEREAS the Agency considers it appropriate to cancel Licence Nos.880134, 880135, 880136 and 890212.

NOW THEREFORE, IT IS ORDERED THAT:

Licence Nos.880134, 880135, 880136 and 890212 are hereby cancelled pursuant to subsection75(2) of the NTA, 1987.
