IN THE MATTER OF the operation of a domestic service and a Class 9-4 Charter non-scheduled international service by Gregco Industries Ltd. - Licence Nos. 882276 and 882277.

WHEREAS under Licence No. 882276, Gregco Industries Ltd. (hereinafter the Licensee) is authorized to operate a domestic service;

AND WHEREAS under Licence No. 882277, the Licensee is authorized to operate a Class 9-4 Charter non-scheduled international service using rotating wing aircraft having a maximum certificated take-off weight not greater than 4,409 pounds;

AND WHEREAS by registered letter dated December 16, 1992, Licence Nos. 882276 and 882277 were suspended pursuant to subsections 75(1) and 97(1), respectively, of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.) (hereinafter the NTA, 1987), for failure by the Licensee to file with the Agency a valid certificate of insurance. The Licensee was required to show cause within twenty-one (21) days from the date of the letter why Licence Nos. 882276 and 882277 should not be cancelled pursuant to subsections 75(1) and 97(1), respectively, of the NTA, 1987;

AND WHEREAS to date, the Licensee has failed to either file with the Agency the required certificate of insurance or to respond to the aforementioned letter;

AND WHEREAS repeated attempts were made by the Agency to contact the Licensee and they were unsuccessful;

AND WHEREAS the Agency has reasonable grounds to believe that, in respect of the services for which the licences are issued, the Licensee ceases to have the qualifications necessary for the issuance of the said licences;

AND WHEREAS the Agency considers it appropriate to cancel Licence Nos. 882276 and 882277.

NOW THEREFORE, IT IS ORDERED THAT:

Licence Nos. 882276 and 882277 are hereby cancelled pursuant to subsections 75(1) and 97(1), respectively, of the NTA, 1987.
