IN THE MATTER OF the operation of a domestic service and a Class 4 Charter domestic service by Mountain Air Flight Training Ltd. - Licence Nos. 920027 and 920092.

WHEREAS under Licence No. 920027, Mountain Air Flight Training Ltd. (hereinafter the Licensee) is authorized to operate a domestic service;

AND WHEREAS under Licence No. 920092, the Licensee is authorized to operate a Class 4 Charter domestic service using fixed wing aircraft in Group A, from a base at Calgary, Alberta;

AND WHEREAS by registered letter dated November 9, 1995, amended by letter dated November 10, 1995, Licence No. 920027 was suspended pursuant to subsection 75(1) of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.) (hereinafter the NTA, 1987), for failure by the Licensee to file with the National Transportation Agency a valid certificate of insurance. The Licensee was required to show cause within twenty-one (21) days from the date of the letter why Licence No. 920027 should not be cancelled pursuant to subsection 75(1) of the NTA, 1987;

AND WHEREAS by registered letter dated November 17, 1995, Licence No. 920092 was suspended pursuant to subsection 75(1) of the NTA, 1987, for failure by the Licensee to file with the National Transportation Agency a valid certificate of insurance. The Licensee was required to show cause within twenty-one (21) days from the date of the letter why Licence No. 920092 should not be cancelled pursuant to subsection 75(1) of the NTA, 1987;

AND WHEREAS the show-cause letters were returned to the Agency postmarked by Canada Post Corporation as "Refused by addressee";

AND WHEREAS to date, the Licensee has failed to file with the Agency the required certificate of insurance;

AND WHEREAS the Agency has been advised that the Licensee has ceased operations;

AND WHEREAS the Agency has reasonable grounds to believe that, in respect of the services for which the licences are issued, the Licensee ceases to have the qualifications necessary for the issuance of the said licences;

AND WHEREAS the Agency has reviewed the matter and considers it appropriate to cancel Licence Nos. 920027 and 920092.

NOW THEREFORE, IT IS ORDERED THAT:

Licence Nos. 920027 and 920092 are hereby cancelled pursuant to subsection 75(1) of the NTA, 1987.
