IN THE MATTER OF the operation of a non-scheduled international service by Bluffton Flying Service, Inc. - Licence No. 951280.

WHEREAS under Licence No. 951280, Bluffton Flying Service, Inc. (hereinafter the Licensee) is authorized to operate a Class 9-4 Charter non-scheduled international service to transport traffic between points in Canada and points in the United States of America;

AND WHEREAS Transport Canada has advised the Canadian Transportation Agency (hereinafter the Agency) that the Canadian aviation document of the Licensee is no longer valid;

AND WHEREAS the certificate of insurance on file with the Agency expired on October 26, 1996;

AND WHEREAS pursuant to subparagraphs 73(1)(a)(ii) and (iii) of the Canada Transportation Act, S.C., 1996, c. 10 (hereinafter the CTA), the Licensee must establish to the satisfaction of the Agency that it holds a valid Canadian aviation document issued by the Minister of Transport and has prescribed liability insurance coverage in respect of the service to be provided under the licence;

AND WHEREAS the Agency has determined that, in respect of the service for which the licence is issued, the Licensee ceases to meet the requirement of subparagraphs 73(1)(a)(ii) and (iii) of the CTA;

ET ATTENDU que le paragraphe 75(1) de la LTC dispose que l'Office doit suspendre ou annuler une licence internationale service à la demande lorsqu'il fait une telle détermination;AND WHEREAS pursuant to paragraph 75(1)(b) of the CTA, the Agency must suspend or cancel a non- scheduled international licence where the Agency has made such a determination;

AND WHEREAS the Agency is of the opinion that in the present circumstances it should suspend immediately the non-scheduled international licence and require the Licensee to show cause within thirty days why the said licence should not be cancelled.

NOW THEREFORE, IT IS ORDERED THAT:

  1. Licence No. 951280 is hereby suspended pursuant to paragraph 75(1)(b) of the CTA.
  2. The Licensee is hereby required to show cause within thirty days from the date of this Order why the said licence should not be cancelled pursuant to paragraph 75(1)(b) of the CTA.

This Order shall form part of Licence No. 951280 and shall remain affixed thereto as long as the said Order is in force.
