Order No. 2009-A-620
December 23, 2009
CANCELLATION of Marlin Air, Inc.'s Licence No. 967706.
File No. M4211/M19-2
In its Order No. 2008-A-492 dated November 13, 2008, the Canadian Transportation Agency (Agency), pursuant to paragraph 75(2)(b) of the Canada Transportation Act, S.C., 1996, c. 10, as amended (CTA), suspended the non-scheduled international licence of Marlin Air, Inc. (Licensee). The Agency took this action because the Licensee did not have the prescribed liability insurance coverage. The Licensee was provided with one year to file an application to reinstate the licence.
To date, the Licensee has failed to file an application to reinstate the licence. Also, the Licensee does not have the prescribed liability insurance coverage.
The Agency concludes that the Licensee does not meet the applicable requirements of the CTA.
Pursuant to paragraph 75(1)(b) of the CTA, the Agency must cancel the licence.
Accordingly, the Agency, pursuant to paragraph 75(1)(b) of the CTA, cancels the licence.
