APPLICATION by African International Airways (PTY) Limited for cancellation of Licence No. 977326 and for rescission of Decision No. 753-A-2005 dated December 28, 2005.

African International Airways (PTY) Limited (hereinafter the applicant) has applied to the Canadian Transportation Agency (hereinafter the Agency) for the cancellation and the rescission set out in the title. The application was received on July 17, 2006.
Under Licence No. 977326, the Licensee is authorized to operate a non-scheduled international service to transport goods on a charter basis between points in Swaziland and points in Canada.
Pursuant to paragraph 75(2)(b) of the Canada Transportation Act, S.C., 1996, c. 10 (hereinafter the CTA), the Agency may suspend or cancel a non-scheduled international licence in accordance with a request from the Licensee for the suspension or cancellation.
The Agency has considered the application with respect to the cancellation of Licence No. 977326 and, pursuant to paragraph 75(2)(b) of the CTA, hereby cancels Licence No. 977326.
By Decision No. 753-A-2005 dated December 28, 2005, the Agency authorized the applicant to carry international bonded cargo shipments to and from the international airports of Mirabel, Hamilton, Gander and Winnipeg and the airport of Windsor coming from and destined to points outside the territory of Canada until December 31, 2006.
Pursuant to section 32 of the CTA, the Agency may review, rescind or vary a decision if, in the opinion of the Agency, since the issuance of the decision, there has been a change in the facts or circumstances pertaining to that decision.
The Agency has considered the application for a rescission of Decision No. 735-A-2005, and finds that there has been a change in the facts or circumstances since the issuance of Decision No. 753-A-2005 and that the Decision should be rescinded.
Accordingly, the Agency, pursuant to section 32 of the CTA, hereby rescinds Decision No. 753-A-2005 dated December 28, 2005.
