Decision No. 625-A-2008
December 23, 2008
APPLICATION by The Owen Sound Transportation Company, Limited to reinstate Licence No. 070120.
File No. M4210/T338-1
The Owen Sound Transportation Company, Limited (the Licensee) has applied to the Canadian Transportation Agency (the Agency) for the reinstatement of Licence No. 070120. The application was complete on December 22, 2008.
Under Licence No. 070120, the Licensee is authorized to operate a domestic service, small aircraft.
By Decision No. 251-A-2008 dated May 9, 2008, Licence No. 070120 was suspended pursuant to paragraph 63(2)(b) of the Canada Transportation Act, S.C., 1996, c. 10, as amended (the CTA). Pursuant to that Decision, the Licensee was provided with a period of one year from the date of the Decision to file an application to reinstate the said licence.
The Licensee submitted a document issued to it by the Minister of Transport dated December 22, 2008 indicating that the aircraft operated under the Licensee's service proposal will, in fact, be operated by Cameron Air Service Inc. under Air Operator Certificate No. 8021.
The Agency has carefully examined the document and is satisfied that it is a Canadian aviation document within the meaning of the CTA.
The Agency has reviewed the application and is satisfied that the Licensee meets the requirements of subparagraphs 61(a)(i) to (iii) of the CTA.
Accordingly, the suspension of Licence No. 070120 imposed by Decision No. 251-A-2008 dated May 9, 2008 is no longer in effect.
Further, to ensure continued compliance with subparagraph 61(a)(ii) of the CTA, the Agency will issue an order pursuant to sections 25 and 28 of the CTA, requiring the Licensee to provide the Agency with any documentation that has the effect of altering or proposing to alter its agreement with Cameron Air Service Inc., or would indicate that the Licensee has entered into or is proposing to enter into a similar arrangement with one or more other parties.
