APPLICATION by Irving Oil Limited, pursuant to the Coasting Trade Act, S.C., 1992, c. 31, for a licence to use the "ACTION" to transport crude oil.

APPLICATION

Irving Oil Limited applied, through its Canadian representative, for a licence to use the "ACTION", a Maltese tanker to transport crude oil, for one voyage, from Whiffen Head, Newfoundland and Labrador to Canaport, Saint John, New Brunswick and/or Point Tupper, Nova Scotia and/or Halifax, Nova Scotia and/or Portland, Maine, United States of America via pipeline to Montréal, Quebec, during the period commencing on or about January 3, 2009 and ending on or about January 9, 2009.

Is there a suitable Canadian ship available to perform the activity?

FACTS AND DETERMINATION

Canadian Transportation Agency (Agency) staff gave notice of the application to the Canadian marine industry and no Canadian ships were offered. Therefore, the Agency determines that there is no suitable Canadian ship available to perform the activity.

The Agency is providing this determination to the Minister of Public Safety and Emergency Preparedness to consider whether to issue the licence. This Decision is not an authority to operate.
