Decision No. 649-A-1989
December 28, 1989
APPLICATION by Warroad Airways, Inc. for suspension of Licence No. 881610 until May 15, 1990.
DECISION: APPLICATION APPROVED.
File No. M4895-W8-4
Docket No. 89709
Warroad Airways, Inc. (hereinafter the Licensee) has applied to the National Transportation Agency for the suspension set out in the title. The application was received on November 29, 1989.
Under Licence No. 881610, the Licensee is authorized to operate a Class 9-4 Charter non-scheduled international service to transport traffic between points in Canada and points in the United States of America.
The Agency has reviewed the application and considers it appropriate to suspend Licence No. 881610 until May 15, 1990. The application is hereby approved.
Licence No. 881610 is hereby suspended pursuant to subsection 97(2) of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.), until May 15, 1990.
The Licensee is hereby required to file before May 15, 1990, an application to reinstate the suspended service which will establish to the satisfaction of the Agency that it still has the qualifications necessary for the issuance of the licence namely that it holds a Canadian aviation document (operating certificate) and has prescribed liability insurance coverage. Alternatively, the Licensee is required to show cause within the same period why its licence should not be cancelled pursuant to paragraph 97(1)(a) of the National Transportation Act, 1987, as failure to file the said application would give reasonable grounds to the Agency to believe that, in respect of the service for which the licence is issued, the Licensee ceases to have the qualifications necessary for the issuance of the licence.
This Decision shall form part of Licence No. 881610 and shall remain affixed thereto as long as the said Decision is in force.
