APPLICATION by Algoma Tankers, pursuant to the Coasting Trade Act, S.C., 1992, c. 31, for a licence to use the "GEMINI", an American tanker, to transport heavy fuel oil for two voyages from either Sarnia or Nanticoke, Ontario to either Tracy or Montréal, Quebec; or from Oakville, Ontario to Montréal, Quebec. These two voyages will be followed by one voyage of clean petroleum products from Sarnia to either Sault Ste. Marie or Thunder Bay, Ontario; or from Sarnia or Nanticoke to Hamilton, Ontario, during the period commencing on or about December 7, 2003 and ending on or about December 31, 2003.

Algoma Tankers has applied to the Minister of National Revenue for a licence to operate the service set out in the title. The matter was referred to the Canadian Transportation Agency (hereinafter the Agency) on November 28, 2003.

The Agency conducted a search of the relevant portion of the marine industry. Notice of the application was given on November 28, 2003. On December 2, 2003, an offer was received from McKeil Marine Limited and on December 4, 2003, the offer was withdrawn.

The Agency has determined, pursuant to subsection 8(1) of the Coasting Trade Act that there is no suitable Canadian ship available to provide the service or perform the activities described in the application.

This determination will be provided to the Minister of National Revenue for any necessary action as provided for in the Coasting Trade Act.

This Decision does not constitute an authority to commence operations in respect of the service for which application has been made.
