APPLICATION by Air Canada also carrying on business as Air Canada rouge and Air Canada Cargo (Air Canada), on behalf of itself and Air Canada rouge LP, as represented by its general partner, Air Canada rouge General Partner Inc. (rouge LP), pursuant to section 32 of the Canada Transportation Act, S.C., 1996, c. 10, as amended (CTA).

Air Canada, on behalf of itself and rouge LP, has applied to the Canadian Transportation Agency (Agency) to vary Decision No. 80-A-2016 to permit Air Canada to provide its international air service, on a scheduled basis, between Canada and Saint Vincent and the Grenadines using aircraft with flight crew provided by rouge LP, for an indefinite period.

In the Decision, the Agency approved:

the use by Air Canada of aircraft with flight crew provided by rouge LP, and the provision by rouge LP of such aircraft and flight crew to Air Canada, to permit Air Canada to provide its scheduled international services on licensed routes, and to provide its international air service on a scheduled basis between Canada and Grenada, using aircraft with flight crew provided by rouge LP, for an indefinite period.

Air Canada is licensed to operate scheduled international services, large aircraft, in accordance with agreements and arrangements between the Government of Canada and various governments of other countries.

Air Canada is also licensed to operate an international air service on a scheduled basis between Canada and Grenada and between Canada and Saint Vincent and the Grenadines.

In its application, Air Canada states that it wishes to commence service to Saint Vincent and the Grenadines using aircraft provided by rouge LP and requests that the Agency amend Decision No. 80-A-2016 to permit Air Canada to use aircraft with flight crew provided by rouge LP on all licensed routes and all other international air services on a scheduled basis.

The Agency has considered the application and the material in support and finds, pursuant to section 32 of the CTA, that there has been a change in the facts or circumstances pertaining to the Decision since it was issued and that it should be varied.

Accordingly, the Agency, pursuant to section 32 of the CTA, varies the approval set out in the Decision as follows:

The Agency approves the use by Air Canada of aircraft with flight crew provided by rouge LP, and the provision by rouge LP of such aircraft and flight crew to Air Canada, to permit Air Canada to provide its scheduled international services on all licensed routes, and to provide all of its international air services on a scheduled basis using aircraft with flight crew provided by rouge LP, for an indefinite period.
