Consultation on Request for Conditional Exemption from the Accessible Transportation for Persons with Disabilities Regulations received on June 13, 2022

The Canadian Transportation Agency (CTA) is seeking input on a request filed by Airlines for America (A4A) on behalf of its member airlines, for conditional exemption from the requirements of the Accessible Transportation for Persons with Disabilities Regulations (ATPDR) related to damaged, destroyed or lost mobility aids on an international service.

A4A has made this request based on the premise that alternative measures provided by its member airlines are equivalent to the requirements of the ATPDR.
The provision of the ATPDR for which they are seeking conditional exemption is:

The CTA will assess the request for conditional exemption for each member airline based on the information provided by A4A to demonstrate that the airline has taken or will take measures that are at least equivalent to those that must be taken under the provisions of the ATPDR.

Deadline for providing input

You have until August 5, 2022 from date of posting, to review and comment on the request.

How to submit input

All submissions will be considered public documents and will be posted on the CTA’s website in the official language in which they were received, along with the name of the individual or organization that submitted them.
Submissions that contain information that should be treated as confidential, should be filed in two versions:

  1. A public version of the document in which the confidential information is not included, and
  2. A confidential version of the document in which:
    • each page is marked "contains confidential information" at the top; and
    • the confidential information that was not included in the public version is identified on each page by highlighting or other means.

Public versions will be posted on the CTA’s website and confidential submissions will be for the CTA’s own use only. However, all input received is subject to the Access to Information Act and the Privacy Act. The CTA will protect the confidentiality of information received in accordance with these acts, but those acts can require the CTA to release information if someone requests it, with some exceptions.
