Disputes about charges and associated terms and conditions

Types of disputes we  can help with

Sometimes railway companies charge shippers for specific activities performed over and above the service to be provided upon payment of the rate, such as:

  • demurrage (taking longer than permitted to load or unload a railcar);
  • cleaning and storing railcars; and
  • weighing goods.

Shippers can complain about charges and associated terms and conditions included in a tariff that apply to more than one shipper (except a tariff under subsection 165(3)).

For more information, please see the Canada Transportation Act, section 120.1.
