Contravention
(A) On or About July 10, 2023, in the Regional Municipality of Waterloo, Ontario, Canadian National Railway Company, did not comply with Agency order 28-R-2023, made under subsection 95.3(1) of the Canadian Transportation Act, directing it to cease arriving at the Derail before receiving clearance from the operator and thus causing idling on the Spur between mileages 0 and 1.53, as early as possible and no later than April 27, 2023, thereby contravening subsection 95.3(1) of the Canada Transportation Act.
(B) On or About July 11, 2023, in the Regional Municipality of Waterloo, Ontario, Canadian National Railway Company, did not comply with Agency order 28-R-2023, made under subsection 95.3(1) of the Canadian Transportation Act, directing it to cease arriving at the Derail before receiving clearance from the operator and thus causing idling on the Spur between mileages 0 and 1.53, as early as possible and no later than April 27, 2023, thereby contravening subsection 95.3(1) of the Canada Transportation Act.
(C) On or About July 12, 2023, in the Regional Municipality of Waterloo, Ontario, Canadian National Railway Company, did not comply with Agency order 28-R-2023, made under subsection 95.3(1) of the Canadian Transportation Act, directing it to cease arriving at the Derail before receiving clearance from the operator and thus causing idling on the Spur between mileages 0 and 1.53, as early as possible and no later than April 27, 2023, thereby contravening subsection 95.3(1) of the Canada Transportation Act.
