Dans un article publié récemment dans le Hill Times, le ministre des Transports a fait connaître son intention de présenter des dispositions législatives qui clarifieraient les responsabilités des transporteurs aériens et les droits des voyageurs. Plus particulièrement, ces dispositions donneraient à l'Office des transports du Canada le mandat d'élaborer une nouvelle réglementation visant à renforcer les droits des passagers aériens.

In a recent Hill Times article, the Minister of Transport outlined his intention to introduce legislation that would clarify the responsibilities of air carriers and the rights of travellers. In particular, the legislation would give the Canadian Transportation Agency a mandate to develop new regulations to strengthen air passenger rights.

La demanderesse a demandé à l’Office des transports du Canada (Office) une licence pour l’exploitation d’un service international à la demande suivant l’Annexe III de l’Accord relatif au transport aérien entre le gouvernement du Canada et le gouvernement des États-Unis d’Amérique signé le 12 mars 2007 (Accord).

L’Office est convaincu que la demanderesse répond à toutes les conditions applicables du paragraphe 73(2) de la LTC. L’Office est aussi convaincu que les conditions pertinentes de l’Accord ont été respectées.

Par conséquent, l’Office délivre la licence.

Conformément au paragraphe 74(1) de la LTC, la licence est assujettie aux conditions prescrites par le Règlement sur les transports aériens, DORS/88-58, modifié, et à celles qui suivent :

  1. La licenciée est autorisée à effectuer des vols affrétés suivant l’Annexe III de l’Accord.
  2. Il est interdit à la licenciée d’acheminer du trafic local entre des points situés au Canada.
  3. Le service international à la demande doit être exploité suivant l’Accord et toutes ententes applicables conclues entre le Canada et les États-Unis d’Amérique.

The applicant has applied to the Canadian Transportation Agency (Agency) for a licence to operate a non-scheduled international service in accordance with Annex III of the Air Transport Agreement between the Government of Canada and the Government of the United States of America signed on March 12, 2007 (Agreement).

The Agency is satisfied that the applicant meets all the applicable requirements of subsection 73(2) of the CTA. The Agency also finds that the pertinent terms and conditions of the Agreement have been complied with.

Accordingly, the Agency issues the licence.

Pursuant to subsection 74(1) of the CTA, the licence is subject to the conditions prescribed by the Air Transportation Regulations, SOR/88-58, as amended, and the following conditions:

  1. The Licensee is authorized to operate charter flights in accordance with Annex III of the Agreement.
  2. The Licensee is prohibited from carrying local traffic between points in Canada.
  3. The non-scheduled international service is to be conducted in accordance with the Agreement and any applicable arrangements agreed to between Canada and the United States of America.
