(A) On or about August 19, 2021, when Flight F8306 was cancelled for reasons within Flair Airlines Ltd.'s control but required for safety purposes, Flair Airlines Ltd. failed to provide, free of charge, food and drink in reasonable quantities to 4 passengers who waited two hours after the departure time that is indicated on their original ticket, thereby contravening paragraph 14(1)(a) of the Air Passenger Protection Regulations. $400.00

(B) On or about August 19, 2021, when Flight F8306 was cancelled for reasons within Flair Airlines Ltd.'s control but required for safety purposes, Flair Airlines Ltd. failed to offer, free of charge, hotel or other comparable accommodation that was reasonable, as well as transportation to the hotel or other accommodation and back to the airport, to 4 passengers who were required to wait overnight for a flight reserved as part of alternate travel arrangements, thereby contravening subsection 14(2) of the Air Passenger Protection Regulations. $1,000.00

(B) On or about April 27, 2022, Flair Airlines Ltd. advertised the price of an air service on the website flyflair.com without including in the advertisement the total price or range of total prices for each optional incidental service offered for which a fee or charge is payable, thereby contravening paragraph 28(1)(e) of the APPR. $500.00

(C) On or about April 27, 2022, Flair Airlines Ltd. advertised the price of an air service on the website flyflair.com without setting out all third party charges under the heading “Taxes, Fees and Charges”, thereby contravening subsection 28(2) of the APPR. $1,000.00

Pursuant to section 180 of the Canada Transportation Act, SC 1996, c 10 (CTA) the undersigned Enforcement Officer has issued this notice of violation believing Tailwind Air, LLC has committed 12 violations of operating an air service without holding a licence issued under Part II of the Canada Transportation Act, contrary to section 57 of the Canada Transportation Act, SC 1996, c 10 (CTA).

(A) On or about October 3, 2021, Jet Select LLC, a non-Canadian air carrier, operated a non-scheduled international service pursuant to paragraph 5(3)(b) of the ATR using an aircraft bearing registration N338JE from Vancouver, Canada (CYVR) to Van Nuys, California, USA (KVNY) without first filing with the Agency, in respect of the service to be provided or being provided, a valid certificate of insurance in the prescribed form set out in Schedule I of the ATR, thereby contravening subsection 8(1) of the Air Transportation Regulations.

(B) On or about October 13, 2021, Jet Select LLC, a non-Canadian air carrier, operated a non-scheduled international service pursuant to paragraph 5(3)(b) of the ATR using an aircraft bearing registration N338JE from Miami, Florida, USA (KOPF) to Toronto, Canada (CYYZ) without first filing with the Agency, in respect of the service to be provided or being provided, a valid certificate of insurance in the prescribed form set out in Schedule I of the ATR, thereby contravening subsection 8(1) of the Air Transportation Regulations.

(C) On or about December 27, 2021, Jet Select LLC, a non-Canadian air carrier, operated a non-scheduled international service pursuant to paragraph 5(3)(b) of the ATR using an aircraft bearing registration N338JE from Montreal, Canada (CYUL) to Boca Raton, Florida, USA (KBCT) without first filing with the Agency, in respect of the service to be provided or being provided, a valid certificate of insurance in the prescribed form set out in Schedule I of the ATR, thereby contravening subsection 8(1) of the Air Transportation Regulations.

(D) On or about January 08, 2022, WestJet failed to provide the reason for the delay, cancellation, or denial of boarding to affected passengers (QQOSEB) thereby contravening paragraph 13(1)a of the Air Passenger Protection Regulations.

(E) On or about January 09, 2022, WestJet failed to provide the reason for the delay, cancellation, or denial of boarding to affected passengers (FEIRAL) thereby contravening paragraph 13(1)a of the Air Passenger Protection Regulations.

(F) On or about December 31, 2022, WestJet failed to provide the reason for the delay, cancellation, or denial of boarding to affected passengers (GHWIFS) thereby contravening paragraph 13(1)a of the Air Passenger Protection Regulations.

(G) On or about December 31, 2021, WestJet failed to provide the reason for the delay, cancellation, or denial of boarding to affected passengers (APIDDX) thereby contravening paragraph 13(1)a of the Air Passenger Protection Regulations.

(H) On or about January 06, 2022, WestJet failed to provide the reason for the delay, cancellation, or denial of boarding to affected passengers (XRGPYM) thereby contravening paragraph 13(1)a of the Air Passenger Protection Regulations.

(B) On or about May 28, 2021, Sea to Sky Air, Inc. carrying on business as Flying Zebra operated an air service using an aircraft bearing registration N245PE from East Hampton, NY, USA (KHTO) to Toronto, Canada (CYYZ) without holding a licence issued under Part II of the Canada Transportation Act thereby contravening section 57 of the Canada Transportation Act. ($4,000)

(C) On or about June 5, 2021, Sea to Sky Air, Inc. carrying on business as Flying Zebra operated an air service using an aircraft bearing registration N245PE from Toronto, Canada (CYYZ) to Hyannis, MA, USA (KHYA) without holding a licence issued under Part II of the Canada Transportation Act thereby contravening section 57 of the Canada Transportation Act. ($4,000)

(D) On or about June 6, 2021, Sea to Sky Air, Inc. carrying on business as Flying Zebra operated an air service using an aircraft bearing registration N245PE from Fredericton, Canada (CYFC) to Teterboro, NJ, USA (KTEB) without holding a licence issued under Part II of the Canada Transportation Act thereby contravening section 57 of the Canada Transportation Act. ($4,000)

(E) On or about June 15, 2021, Sea to Sky Air, Inc. carrying on business as Flying Zebra operated an air service using an aircraft bearing registration N408FZ from White Plains, NY, USA (KHPN) to Fredericton, Canada (CYFC) via Montreal, Canada (CYUL) without holding a licence issued under Part II of the Canada Transportation Act thereby contravening section 57 of the Canada Transportation Act.
